By accessing or using the Big Bad Beds website and music library (the "Service"), operated by Audio Branding Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Service.
You must be at least 18 years of age to use the Service and enter into a subscription agreement. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into a binding agreement.
To access certain features, you may be required to create an account. You agree to provide accurate and complete information and to keep your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at legal@bigbadbeds.com if you suspect unauthorized access.
Access to downloadable content requires an active paid subscription. Subscription fees are billed in advance on a recurring basis. All payments are non-refundable except as required by applicable law. We reserve the right to change subscription pricing with reasonable advance notice to active subscribers.
Subject to your active subscription and compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to use music tracks from the library for the purposes described in our License Agreement. This license is revocable upon termination of your subscription or breach of these Terms.
You agree not to: (a) redistribute, resell, sublicense, or share access to music tracks or your account credentials; (b) use the Service for any unlawful purpose; (c) reverse engineer, scrape, or attempt to extract source audio or metadata at scale; (d) claim authorship of any music available through the Service; or (e) use the music in a manner that infringes third-party rights.
All music, artwork, metadata, and other content available through the Service are the property of Audio Branding Inc. or its licensors and are protected by copyright and other intellectual property laws. Nothing in these Terms transfers ownership of any intellectual property to you.
We may suspend or terminate your account at any time for violation of these Terms. You may cancel your subscription at any time through your account settings. Upon termination, your license to use any downloaded content is governed by the License Agreement in effect at the time of download.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
To the fullest extent permitted by law, Audio Branding Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid in the twelve months preceding the claim.
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Dallas County, Texas.
We may update these Terms from time to time. We will notify active subscribers of material changes via email or in-app notice. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
